The FCC Requires an American Who Can Be Sued Behind Every Imported Handheld. In 22 of 23 Filings, It's One of Seven Agencies
SEO Title: Who is legally answerable for your handheld?
Excerpt: Every foreign company that certifies a game console or handheld for sale in the United States must name an American agent who can be served with legal process โ and must keep that agent on file even after the product leaves the market. We read the attestation letters behind all 28 console and handheld certifications filed in 2026. Twenty-three resolved to a named agent. Twenty-two of those name one of seven outside agencies, two of which account for fourteen between them; the only company that named its own subsidiary was Nintendo.
The letter is one page, and it is filed inside the application, not on top of it.
It begins, as all of them do, addressed to the Office of Engineering Technology at the Federal Communications Commission in Columbia, Maryland. It gives a company name โ FCC US Agent, LLC โ a registration number, an address in Saint Charles, Illinois, a telephone number, and a support mailbox. Then it names the applicant: a Shenzhen handheld maker, and the product it wants to sell in America.
The last paragraph is the part that matters, and it is identical in wording across the industry:
"[The applicant] accepts to maintain an agent โฆ after the grantee has terminated all marketing and importation or the conclusion of any commission related proceeding involving equipment."
That sentence is not boilerplate invented by a lawyer for a test lab. It is lifted, nearly verbatim, from the Code of Federal Regulations.
What the rule actually requires
OBSERVED FACT: 47 CFR ยง 2.911(d)(7) states: "The applicant shall designate an agent located in the United States for the purpose of accepting service of process on behalf of the applicant."
OBSERVED FACT: The same paragraph requires a certification signed by both the applicant and the agent, acknowledging "the applicant's consent and the designated agent's obligation to accept service of process in the United States for matters related to the applicable equipment, and at the physical U.S. address and email address of its designated agent."
OBSERVED FACT: Subparagraph (i)(C) extends the obligation well past the end of sales: the agent must be maintained for at least a further year after the grantee permanently terminates marketing and importation of the equipment, or after any Commission-related administrative or judicial proceeding involving it concludes, whichever is later.
OBSERVED FACT: The eCFR's amendment note for ยง 2.911 reads "[80 FR 33440, June 12, 2015, as amended at 88 FR 7623, Feb. 6, 2023]". The U.S.-agent requirement therefore dates from the February 2023 amendment implementing the Commission's equipment-authorisation overhaul (FCC 22-84).
INFERENCE (confidence 90): The provision exists so that a foreign manufacturer with no American presence can still be reached โ by the Commission, by a court, by anyone with a claim โ for as long as the device is on the market and for a year afterwards.
What the rule does not do is say who that agent should be, how large the firm must be, or whether the public may look up the answer.
The audit
To find out how the console industry actually satisfies that obligation, this desk located every FCC equipment authorisation filed in 2026 whose equipment class or product description is a game console or a handheld game console โ the full-text search surface at fccid.io, four query variants, de-duplicated โ and then opened the 2.911(d)(7) attestation exhibit inside each application.
OBSERVED FACT: The audit covers 28 unique console and handheld FCC IDs. Of those, 23 contained an attestation letter with a text layer that names the agent. Five contained only a scanned image with no text layer and are counted as unresolved. (A twenty-ninth result, 2BDUL-SZ-5008B, is a game controller and is excluded from every figure here.)
OBSERVED FACT: The 23 resolved filings name eight entities:
| U.S. agent named | Filings |
|---|---|
| GLOCERTS TECHNOLOGY INC | 9 |
| FCC US Agent, LLC | 5 |
| HOPEK CORPORATION INC | 3 |
| HOORAY INDUSTRY LLC | 2 |
| CLF Import and Export Limited | 1 |
| Iconsigh Inc. | 1 |
| ProGears Technology Inc. | 1 |
| Nintendo of America Inc. | 1 |
INFERENCE (confidence 85): Twenty-two of the twenty-three resolved filings route the obligation to an outside agency. The single exception is Nintendo, the only applicant in the set that named its own American subsidiary.
Two agencies account for fourteen of the twenty-two.
OBSERVED FACT: GLOCERTS TECHNOLOGY INC appears on nine filings โ the six-model June 2026 batch from Shenzhen Yangliming Electronic Technology, two handhelds from Shenzhen ShijiaMei Industrial, one from Shenzhen Yaoyue Electronic Technology and one Android handheld console from Shenzhen TongxinChenda Electronics. Its filings give a Riverside, California address and a registration number, 0036339737.
OBSERVED FACT: FCC US Agent, LLC appears on five โ two Mangmi handhelds, a Hong Kong Lelegao console, a Qianhai Xinguo handheld and AYN's handheld. Its website describes the business directly: "We provide non-USA applicants lifetime representation of your products," and prices it as "Lifetime Pricing โ One time charge per product."
OBSERVED FACT: HOORAY INDUSTRY LLC, at a Fullerton, California address, appears twice, once on a Yangliming handheld and once on a Moorechip retro handheld. HOPEK CORPORATION INC, at a San Diego address given in its own letters as an apartment unit, appears three times, all on consoles from Shenzhen Ruishuo Network Technology.
The company with two agents
The most revealing detail in the set is not who the agents are. It is that the designation attaches to the FCC ID, not to the company.
OBSERVED FACT: FCC ID 2AJU8-RG476H, filed on 27 November 2025, names HOORAY INDUSTRY LLC. Seven months later, on 17 and 18 June 2026, the same company filed five more handhelds โ RG477V, RG34XXSP, RGROTATE, RG556 and RG35XXPRO โ and all five name GLOCERTS TECHNOLOGY INC instead.
INFERENCE (confidence 80): A single contract manufacturer, certifying a single family of devices across two separate batches of models, used two different American agencies. Whatever the reason, the practical consequence is that "who is answerable in the United States for this company's consoles" has no company-level answer. There are as many answers as there are model numbers.
OBSERVED FACT: The rule permits this. Nothing in ยง 2.911(d)(7) requires one agent per applicant, and nothing requires the agent to be independent of the applicant.
OBSERVED FACT: One of the seven agencies is effectively in-house. Shanghai ABXY Tech's designated agent, ProGears Technology Inc., of Spokane, Washington, is reached at the same email address as the applicant itself; the same person signed both halves of the letter.
What the lab checked
The most useful document in the whole set is not an agent letter at all. It is the exhibit a test lab attached when a certification body asked it to explain how it verifies a newly named agent. The file sits inside FCC ID 2AYG3-S010-01, a game console from Shenzhen DongShengXuRi Electronics.
OBSERVED FACT: The exhibit reproduces the question โ whether the address is "a valid physical US mailing address (not a US post office box, not a virtual mailbox, not P.O. Boxes, not a vacant lot, not a public building)" โ and answers it:
"We have checked if the address exists in a real and potential building (Google maps) + official US register, after this verification and the evidence below we can guarantee the following: not a US post office box, not a virtual mailbox, not P.O. Boxes, not a vacant lot, not a public building"
The exhibit then attaches a Google Maps view and a New York State entity search, and concludes: "The ASOP defined and provided by grantee is VALID and confirmed."
INFERENCE (confidence 75): The check is geographic and documentary. It establishes that a building exists at an address. It does not establish that the agent holds records for the device, has ever seen it, or could answer a subpoena about it.
The year after the last sale
The clause that has attracted no attention is the tail. The agent's obligation does not end when the product stops shipping.
OBSERVED FACT: Under ยง 2.911(d)(7)(i)(C), the applicant must maintain the agent for at least a year after it "permanently terminated all marketing and importation" of the equipment, or after the conclusion of any Commission proceeding involving it โ whichever is later.
INFERENCE (confidence 70): The register of 2026 designations is therefore not a snapshot of who is selling what. It is a standing list of the American parties who remain answerable for devices already in people's hands, including for brands that will have disappeared by the time anyone wants to ask.
INFERENCE (confidence 75): No public version of that list exists. The Commission's rule imposes no publication duty, and the designation is visible only inside the exhibit file of an individual application. Finding out who stands behind one handheld means opening that handheld's FCC ID and reading the PDF.
The strongest case against this story
The fair reading is that this is the system working as designed. A sub-$200 handheld from a Shenzhen factory has no American subsidiary, no American lawyer and no American office. The 2023 rule did not create that situation; it created a lawful way to handle it. Commercial agents are the ordinary instrument for exactly this, used across imported electronics of every kind, and choosing one is not a shortcut or a dodge.
That reading is correct, and it is why none of the filings above is alleged to be non-compliant. The agencies named here are real firms with registration numbers, and the letters are signed by both parties, as the rule requires.
What the record supports is narrower and still worth publishing: the accountability layer between an imported console and an American courtroom is thin, fragmented by model number, verified by an address lookup, and invisible to the public. The Commission can serve process. Whether anyone else can find out on whom is a different question, and the rule does not ask it.
OBSERVED FACT: This is also not unique to gaming. GLOCERTS appears in the same corpus on a wireless charging mouse pad, an anti-loss tag and a Qi module; the same agencies serve toys and chargers. Gaming is simply where the pattern is most visible, because the devices are branded, retailed and reviewed as consumer products rather than as components.
Why it matters now
OBSERVED FACT: 2026 is the year the import channel for these devices came under sustained pressure. On 7 October the Entertainment Software Association asked the U.S. Trade Representative to target "piracy devices" at the border. On 8 October U.S. Customs and Border Protection published a proposed rule that would convert every low-value parcel โ the delivery channel for the sub-$200 handheld โ into a bonded, brokered customs entry.
INFERENCE (confidence 65): If enforcement in that channel increases, the U.S. agent is the only domestic party the paperwork names. That makes the seven agencies above, and the per-model map behind them, the practical edge of any action โ and a dataset nobody has assembled.
SPECULATION: Whether any agency would be equipped to respond is not something the public record answers. No filing in this set describes what an agent does when it is served.
What to watch
- Whether the Commission ever publishes a designated-agent register, or adds an agent field to its public equipment database.
- Whether the five unresolved filings โ Huitong Botai's Lenovo-badged handheld, Chuangzhanhong's RG36 Pro, two DongShengXuRi consoles and Moorechip's second retro handheld โ name the same agencies once readable copies are filed.
- Whether any 2027 application names a U.S. subsidiary rather than an agency, which would be the first sign that a retro brand is building American corporate presence rather than renting it.
